Hi,
I am currently working in a central govt. company (B).
Prior to this I was working in another central govt. company (A).
While working in A I applied for a central govt. job (C) through proper channel.
I have now shifted to B and am in probation period.
Now C is asking for interview with NOC.
B will not issue NOC since I am in probation.
Can I take the interview through A's letter on proper channel?
What to do after that?
Please suggest.

Dear Sandip,
Though your application for C is thru A, your employment contract with A is over now and as such the NOC has to be issued only by your present employer who is B. No necessity for presumption of refusal of NOC by B on the ground of your probationary status. Try your best to convince B and obtain NOC. Since C is also Central Govt., I don't think that there would be any objection from B if you assure them in writing that you will comply with notice period obligations,if any in the event of your selection for Central Govt.Services.

Thank you for your reply. I have talked with them, they are strict in not giving NOC during probation. Can you suggest what to do in this case? Is NOC mandatory during probation period? Thanks in advance.

You are in a tricky situation. Giving NOC for job change during probation period or not is a matter of discretion of your present employer. But, they can't compel a probationer to remain in their services when he is selected for a better job of his choice and if at all, they can compel him to fulfil the notice period obligations,if any. The point here is that you are just called for the interview only by the prospective employer with a NOC from the present employer.As of now, it does not guarantee your selection. So, I am not able to understand the logical reason behind their refusal. Better make an appeal to the higher up in the hierarchy. Even if it fails attend the interview without NOC and explain to them your inability and assure them your timely joining in case you are selected. Be prepared to face the notice period even by buying out. Let's see whether good sense prevail.

Umakanthan ji, Thank you for your reply. I talked with the highest authority there is in the institute. They are not issuing NOC during probation. But is it true that NOC is not required during probation in Central Govt. jobs? I have in some places over this forum stating this. Can you clarify on this.Thanks.

Dear Sandip,
Sorry, I can not say anything conclusively about issue of NOC by the employer to a serving employee in the event of applying for a job under another or attending an interview in this regard particularly during probation; it depends on the service regulations. The purpose behind NOC is only to facilitate change over in the event of the candidate's selection. Generally in Govt. service, both Central and State, since it is only a transfer of service, NOC is not insisted but application has to be routed through proper channel. In the case of Public Sector Undertakings, inter-unit transfer is not possible for the reason each such unit is a separate entity having its own service regulations that need not be identical. Anyway, when going for the interview, mention the same purpose in your leave application. Best of Luck!

Thanks for the replies. The statement mentioned in the interview letter is that "If you have not applied through proper channel you should produce no objection certificate from present employer". They are not aware that I am currently on probation.

I am in academics. I heard of a rule stating "NOC is given to regular employees".
I am on contract (tenure track) for three years initially and also the appointment letter does not say anything about probation. But in academics it is assumed that the first year will be in probation by default (as far as I can get from my contacts). Does it mean I am not a regular employee?
Umakanthanji, if I mention the interview in the leave letter most probably they will not approve it, since they have already rejected the NOC-application.
As the interview letter says I have to produce NOC at the time of interview if I have not applied through proper channel, logically, I should produce an NOC from present employer (as I inferred).
