Dear Sheeba,

Sickness, illness, disease etc., are terms very loosely and interchangeably used in common practice though all refer to the negative condition of health or the modes of ill health.

In my opinion, as a layman, sickness is some sort of illness lasting for a shorter duration and curable with immediate medical care and treatment.

Illness, on the other hand, is the untreated sickness which lasts for a longer duration and gets cured in due course by more focused medical attention and treatment.

Disease is a pathological chronic condition of ill health diagnosed by a competent medical professional and treated over a period of longer duration.

Therefore, I am of the opinion that sick leave contemplated under the Labor Laws does not require any medical certificate as an evidence for sickness is an unexpected and sudden illness lasting for a shorter duration only.

In many organisations , a threshold limit of two/three days is set beyond which a medical certificate is required in support of sick leave application. Even Government organisations do not insist on medical certificate for one day sickness.
Yet, if it is felt that the employee is feigning sickness and is trying to take advantage, you can insist on medical certificate or in the worst case ask the employee to present himself before the Medical Practitioner of your choice. The employer has a right to be sure of the employee's health particularly looking to the recurrent sickness.

What I understand from your question is that can a person take sick leave by claiming the same with some intervals i.e. one day leave and one or two days present or like that. If my understanding is correct then employee can do.
You may check with your company policy or certified standing orders about the utilization of such leave and act accordingly.
