Dear
Every company has different rule about it. Please refer the Leave manual of the organization.
You can refer: Shops & Establishment Act, Factories Act for further inputs in the matter.
In most of the cases, The PL (Privileged Leave) / EL (Earned leave) are linked to the length of service in the organization, and is credited to the employee after completion of one year of service.
Factories act do state that the individual should have been present of minimum of 240 days for becoming eligible for EL.

Dear All,
Pl is earned on the basis of working days. Forwarding the balance PL for the next year is totally depend on the company policy.
Some company is forwarding the pl for the next year as per their notice period while employee is leaving the organisation, if notice period is 60 day company is mataining the 60 days pl accumulation of the next year.
if anybody lwants to eave within two months so he will pay two month's salaryto the company or to work two months and take encash the balance pl.

Dear Indu, I do agree with Hombal coz in my company maximum limit of EL/PL accumulation is 75. It is purely based on your HR strategy and company policy.

Dear All

As per Sales Promotion Employees Act, 1976 Sec.14 Earn Leave Can be accumulated 180 days of which the employee can avail himself 90 days at time.

Encashment of leave 120 days.

Dear sir,
if a Small company(SSI) partnership form wants to introduces leave policy after 4 years of establishment, how the leave policy should be implemented? How the Earn leave is calculated ? it is from the current year or from past years? . pl.clarify.

Dear Indu The EL / PL accumulation policy is purely depends on the company description, if company wants to give benefits to the employee, depends on the PL alloted per year

Dear all, I just resigned from manager post in a manufacturing industry on management staff cadre.my leave credit is 32 days while resigning and 92 in jan17 and 88 in jan16. Our company says they neither consider for waiving nor encash and says only applicable for workers and not management staff sice we don't come under trade union act. Guess my company comes under factories act and shop & est act tamilnadu. Am I eligible or not.

Dear All,
Upto 3 years your Earned leaves can be carry forwarded but not your other leaves.
And at the end of 3 years your EL will lapse so as per labour law you can encash maximum 30 EL on your basic pay not on gross pay.
Yes, it's completely depend on company/employer whether he wants to adopt this policy or not But I couldn't find anywhere that based on skills(workers & management) leave encashment will also vary.

More than denying leave encashment in every annual year denying it to consider in waiving off for balance notice period or pay on exit is what wounding. Moreover they claim that all is applicable for workers and not for management staff. My leave credit from 2008 till now is as of every Jan is 41,42,51,51,51,50,60.5,75.5,88.5 and 92 in 2017 Jan and 35 in Oct 2017. My gross is 54k and basic is 12k. Served 36 days without pay hence 36*2 equals 72 days leaving 18 days having unclaimed previous close to 70000 of medical and conveyance. With all this they say I have to 250 RS. My one day wage is 1802 for calculation. Do you think I should conpromise with their calculation.
