Dear all,
My query is this, i have an employee who is not performing up to the expectation of the organisation. Therefore, the management decides to transfer her to another department. Her present designation is sports clerk, so the management plan to appoint her as receptionist and she will be given the same salary as her present job.
Is this legally right and is there any procedure i need to follow?
Please advice me accordingly.

Are her goals idnetified and specific, does your organization have a action plan or an improvement policy, is the employee a confirmed employee.
in case the employee does not perform as a receptionist also...what would be your next steps?
Ideally she should be on a Performance Improvement plan and if it does not work out, per conditions specified in the appointment letter, you can ask her to leave

It all depends up on her terms and condictions of employment in the appointment letter. If there is any clause that she is not transferable to any other post or to any oteher premises etc, then you may encounter a legal problem. Please check.
