Sir, we are planning to shift a specific operation to other state and requested the employees working in particular area for transfer. There is also clause in the appointment order clearly stating that transfer if necessary, the management reserves the right to do it and this was also signed by the employees. In this situation they refused to go on transfer. The management alternately, negotiated with them for settlement (some amount). they are not ready to accept it. The management could not retain them in some other department as already the strength is more. Please suggest what stand the management should take in this situation.

Regarding Transfer
I assume that, you want to shift specific operation & employees to your another unit which was & is existed at the time of appointment of these employees. You may transfer, only thing that you have to re-structure their salary/wages based on rural/urban basis plus you consider Transfer Allowance for these employees. Even after doing as above if they refuse for transfer, ( Pl remember Transfer should not be Malafied) you can Retrench them as per I D Act & appoint new employees for the unit under reference.
