[QUOTE=shilpichauhan87;1873108]Greetings!

We think its illegal need to through out study the same as

1. almost many of the Companies incorporated in India are following Sandwich Rules wherein if a employee takes leaves and between those leaves if any non working day or a public holiday falls the Companies mention all those days as leaves in their attendance sheet and deduct the wages of the employee accordingly

2. That in such case of deduction the contribution towards the employees provident fund is also deducted by the employer

3. That all the Companies are required to submit the leave calendar as per the shops and establishment act wherein it declares that during these days there shall be no work in their undertaking but even in these cases wages are deducted by Companies by following the Sandwich Rule

4. That no Company mention the sandwich Rule in their offer letter or appointment letter being issued to the Employees

5. That even the wages are deducted for the public holidays including Independence day

6. That all the citizens working in private and public Companies are facing due to this illegal Sandwich rule followed by the companies

7. That further in case of leave only basic wages are to be deducted????? to be checked

Need to check all the labor laws whether its legal or not

Dear Madam,
In Leave policy, if We are working on monthly rate, suppose(it means) Rs, 10,000/- salary per month of xyz employee, than weekly off (sunday) will be counted as leave.[Salary calculation = 10,000/ (Monthly days) * Payable days (Including Weekly off).]
But if we are working on daily rate basis of worker, it means Rs. 305/- per day of employee, than weekly off (Sunday) is not counted in leave, in this case employee has to filled up leave only for saturday & monday only.(Wages Calculation is Rs.305 * Payable days (Without Weekly off)
Generely staff category is on monthly rate & Worker category is on daily rate basis working and also decided this method in almost company.
