A comprehensive answer to the responsibility of the principal employer under the CLRA Act and the compliance to be done by the principal employer requires a full study of the Act itself. In short, it can be said that the PE is primarily responsible and the contractor has a supporting role. Primarily, all issues regarding compliances have to be answered by the PE, and the compliances done by the contractor can be made use of.

There is only one difference between the company employee and contractor employees is only about to onroll and off roll .
so if you talk about the responsibility of principal employer in contractor, you have to loom in following -
01. Registration of principal employer ( RC ) under the CLRA act. ( if workers limit is as per state act)
02. Separate Contractor license for respective unit.
03. Employees muster roll or employees application form where as all information related to employee should be filled. all education/technical qualification certificate.
04. Employee induction program regarding company policy and safety policy, product , HR policy and other rules belonging to Company.
05. EPF Act- Employee declaration form, employee E- Nomination and their contribution remittance on monthly basis. if possible a training program should be conduct about the passbook and portal operations as well how to read the passbook and other aspect.
06. ESIC Act- Employee declaration form, their contribution remittance on monthly basis. if possible a training program should be conduct about the contribution period ( April to Sep & Oct to march) , family addition and deletion , information about the nominee and portal opeartions as well how to read the their own portal . training about the benefits about the medical benefits and others.
07. PW Act- employee should be aware the act also for regarding the payment disbursement , method and all others .
08. MW act - to pay minimum wages as per state government fix.
09. Salary/Wages _ give a proper training about the calculation of wages , so that unnecessary chaos will not began.
10. Insure for double overtime and payment of national and festival holiday .
11. annual return by principal employer and half yearly return by the respective contractor.
12. nos. of contractor employees should be checked either it is as per contractor license or not.
13. Bonus payment as per rules .
most important you have to check that there should not be any direct relation between the employer and contractor employee in any way. means no leave, gatepaas and other should by signed by the company representatives. for this you have to dealt via contractor supervisor.
