Politely approach your ex-organization HR head/Authority of organization for explain about the PG act.
If the employee terminated by the company in the cause of fraud/theft after >5 years then only the employee will not eligible to get the gratuity. As per the act if any employee worked for 4.8 years those employee will get eligibility for Gratuity.
U/s 2(s) of PG Act your gratuity is : Basic+DA/26*15*6
Penalties
Rule-9
• Imprisonment for 6 months or fine upto Rs.10,000* for avoiding to make payment by making false state-ment or representa -tion.
Imprisonment not less than 3 months and upto one year with fine on default in comply-ing with the provisions of Act or Rules.
