Hello everyone, I'm working in a company in Haryana State. We have 5 Security guards. All the guards do their duty in shifts (8 hours) every day. We are not providing weekly off to any one of the guards. Another worker's duty hrs is 9 including half an hour lunchtime and 15-15 minutes tea break. Now the question is, are they also eligible for weekly rest? If yes, how can they manage their duty shift (8 hrs or 9 hrs)? Please suggest me briefly.

Every employee is entitled to a weekly off. This is the rule both in factory and in offices / shops / establishments.
Not providing weekly off is an offence under the act but also it can lead to criminal prosecution in case there is an accident that can be traced back to overwork, fatigue and exploitation of labour.

How to manage the work? It is simple, you need to hire one more security guard so that there is adequate number of person on any day that one of the guards is on his weekly off

Would like to know whether your security guards are deployed through contractor, OR
are they employed under direct pay roll of your Company. In both cases, Security guards
are supposed to avail adequate rest

If they are your direct employees, you need to allow them to avail one day weekly off for every six days continuous work. If they are deployed through contractor, you need to pay 1/6th of reliever charges (based on their monthly salary) and ask them to deploy additional guard(s) on Sunday.

Naveen, you do not need a deployment format.
Based on your business requirements, decide which days you cannot give anyone leave. The remaining days, just assign a weekly off to one of your guards. That is enough.

Just try and follow the weekly off dates as strictly as possible. Changes there invites chaos and problems.
