Hi, I'm a senior HR Manager of Recruitment staffing, We have an issue with one of employees and want to file a criminal case for forging the company's reliving letter, Experience letter.

He has been working with us for the past 6 years and Last march 2020 he tried switching the company without resignation and joined in a new company and fortunately, we have received BGV and taken necessary action of holding him and taken a letter of with Apologize, and we made a mutual agreement signed by him not take any legal action and given him a second chance as he was a very good employee and understood the mistake and take sign on below pointers.

1. On signing the contract, If you leave the company within 4 years from the date of accepting this contract. In case of any breach of this contract, you agree that can take strict legal actions against you on the counts of breaching this contract and on the count of forging the Director's signature and creating the fake relieving document.

Now he has Quit the job showing medical certificates after 2 years, that he is ill, he is mentioning that he will commit suicide if we raise any legal complaint on me.

We don't want to leave the issue here, For us it's breaking trust when we have trusted him the second time and he has cheated us again after signing the document. We have all proofs of his documents which he committed a crime and write confirmation from him. We want him to be an example when employees of my company try to do something like this.

What are the steps to take forward the issue, please suggest?
