According to the Employment Contract between the Employer and the Employee (Employed Person), which is the Legally Enforceable Rights & Duties/Obligations, No Emplored Person Can Proceed on Leave without Prior Written Permission of the Employer ( Employers Agent i.e. The Management) Granted / sanctioned on the Baiss of a Leave Application submitted and admitted before availing the Leave of Absence without which
the Absence From Duty Must Be Treated as Unauthorized Absence from Duty disrupting the Operations of the concerned Establishment and thus amount to Act of Misconduct for which the Absenting Employee is liable to Disciplinary Action.
How Come / Does any Employee proceeds on Unauthorized Absence-A Misconduct and when s/he resumes Duty and applies for Grant of Leave with or Without Wages , the Leave of Absence applied for is Granted.
Enforcing Discipline is Employers Prerogative/Priviledge that is Non-Negotiable.
