After union election ,three aggrieved employee of the same union informed the management that the said election has been challenged in civil court and they also informed us that due to the internal dispute the name of newly elected members have not been entered in the form B
In this situation it has become difficult for the Management to hold any discussion in any matter with the newly elected members as the validity of such discussion held with any of the party may be affected after the judgement of the court
In view of the above circumstances kindly let us know the representative character and bargaining right of the contending union OR any alternative suggestion for smooth industrial relation environment

Due to intra union dispute pending before the Civil Court, whether the management got any interim direction from the court regarding the representative character of any group of the disputants so far?

No, still order has not been passed by the civil court, The president of the union and the Election officer has filed a reply in the civil court where as the Commissioner of labour did not file any reply. In the mean while the existing union has enhanced the union subscription from Rs. 5/- to Rs. 15/-without placing the matter in the General body meeting and taking the consent of majority of the members of the union.

The union has called for the general body meeting on the said subject and only 10 to 15 workers have attended the general body meeting and they have only given their consent for the increase of subscription

The existing union has deleted the name from voter list with a plea that they are not ready to pay enhance subscription although they were ready to pay old rate of subscription but existing union has not accepted the subscription of old rate.

The opposition group consisting of 36 members has conducted a general body meeting separately on election day and has dissolved the union and formed an ad-hoc committee. and utilising the same letter pad of the union

Now both are calming genuine union

Under the above circumstances can management recognise the majority group
