Dear All,
Please note that I have worked in a limited company for 3.5 years and every year at the time of Diwali, the company paid me bonus every year as per company policy. But when I resigned on July 2013 (before Diwali), the company did not pay me bonus for 15 months (period april12 to June13) in my full & final settlement.
Please suggest, whether the company liable to pay me bonus for that period ? Can I take any action against the same matter ?

If it is a bonus payable as per POB Act ,then you are eligible.Otherwise it depends on Company policy. Varghese Mathew

Dear Dinesh,
As per Payment of Bonus Act, the employees drawing less than or equal to 10,000 are only covered. Rest are not mandate for the employer to pay. However if the bonus is one among CTC and paid yearly then you've the rights to seek the bonus.
Please go with your company before pleading before any court of law. Try to find solution amicably.

As per Bonus Act, an employee who is having Basic salary 10,000 or less than this is eligible for bonus. All the organisation have to pay Bonus after 5 year of establishment.
In Bonus act, it is clearly mention that An employer have to declare the Bonus competition of 09 months from 1st April.
As per the calculation you will receive the bonus before 30th of November.

Usually bonus is related to business done during last financial year, and paid during current diwali. If at all, you are eligible, this diwali you should get Bonus related to april 2012-march 2013. Next diwali your company will pay you the bonus for april, may , june 2013.
