Dear Mayurmendhekar

As per Contract labour Act, it is the duty of the contractor to provide all the facilities. In case the contractor fails then only the obligation starts from the side of Principal Employer. Here the Principal Employer will give the facilities at the cost of the Contractor and not on their own cost.

But it is the duty of the Principal employer to ensure that the adequate and required facilities are given the contractor workmen (Canteen, First Aid / Medical to injured workmen, Toilet facilities, Wash area, Rest Room, Wholesome Potable Drinking Water are to be provided. The Principal Employer must ensure that the Contractor is regularly paying the workmen their wages, Double Over Time Payment, Bonus, PF, ESI, (Gratuity and Leave Wages, Notice Pay, Retrenchment Compensation as per their eligibility at the time of Retrenching the workmen), safe working environment, etc. are to be provided by the Contractor and it should be periodically checked by the Principal Employer.
