Dear Friends,
1 if any employee covered in ESI & meet a road accident while going home or coming to duty whether he can get the benefits of ESI ?
2 if an employee covered in ESI & meet a road accident while he is on official duty (OD) outside the plant ?whether he can get the benefits of ESI ?
3 If if an employee covered in ESI & meet a road accident while he is coming to duty or going to home after finishing his duty in Company bus ?whether he can get the benefits of ESI ?
Pl clarify the situation in all these three different condition ?

In all three cases, if the employee visits the ESI dispensary for medication and checkups, only then ESI would consider anything.
Else, the employer must have taken GPA policy, thus employer can lodge a case before the insurance company for compensation upon the accident.

Hi Vikram,
In all the three cases, ESI claim is applicable provided that the employer fulfills the following requirements under ESIC Act.
1. Filing of the concerned employee's Declaration form in Form-3 with
ESIC Branch Office, within 10 days of joining
2. Allotment of Insurance No. by ESIC and issue of ESI-Identity Card
3. Remittance of ESI amount through challan in authorised Bank
4. Filing of ESIC Returns in Form-6 (Six months returns).

A few years back there was a case concerning BEST (Maharashtra) & one of its employees who was gravely injured and then died. I don't have the full facts of the case with me. however the ruling of court was from the moment an employee steps out of his home to go to office till he gets back home is covered under workmen compensation act.

In all three cases you can't get ESI cash benefit, injured person can get medical care only. ESI covered only during the course of employment. Its not covered out of the employment. Let me explain one example....
One of our employee goes to his home after completion of his duty. While he was get into the bus slipped from bus steps and got injured to his right wrist. We have submitted the Accident Report but the ESI manager has not accepted because it was happened after complition of his duty, he was not performing his duties at the time of accident. Even he was within the premisses he was not eligible for benefit.

i want letter of undertaking of employee for accident or any physical damage that responsibilities are only of employees not of employer and he or she agreed to do this job of their own risk

Dear Vikram,
All three cases that you mentioned are covered under ESI and members will avail benefit from the coverage. All cases will be treated as accident on duty.
To avail these benefits you need to admit the victim to the near by hospital and inform to the branch office and they will do the needful.
