The Workmen Compensation Policy will not supersede the ESI schemes. It just covers one kind of benefits, ie, accidents while on duty. But there are so many other benefits attached to ESI which include sickness benefit for about 90 days, maternity benefits like 26 weeks leave and medical bonus, free medical treatment to employee as well as his family and dependents and many other. Therefore, if you want to get exemption from ESI, you will have to establish that the schemes and insurance are better than what the ESI Corporation is offering to the employees. I don't think that any private insurer will be able to extend medical coverage to the employees' parents who may be 80 or 90 years of age!
