As HR Managers / executives do not encourage such withdrawls of PF. or re-instatement of the employees after submission of their resignation

Hi,
this is very common in industries particularly worker category, only thing what HR can do is guide them for future benefits of PF, also top management should help in employee welfare that also HR should put proposal in front of management with documentation.
Also in one instance you accept the resignation and the employee is working unregistered in your organization, their is a risk...lot of risk.....so try to have a fair HR practice, educate employees and employer both with supporting document on benefits and welfare of PF and if money is problem employer can help.....

Actually unknown employees are withdrawing their EPF and EPS amount, but they lapse their period of working 4&1/2 yrs for EPS, kindly guide to them, in this case if he want to withdrawn their EPF (Form 19) he can do but not withdraw Form 10C (EPS)

PF can be withdraw by employee when any of event occur which is mentioned in the attached list OR employee become unemployed for 60 days ( 2 months ) after resigning ( last day of job ) from the job.
If any employee is trying to withdraw PF by intention to encash PF/PS amount then it is not allowed.

this practice normally adopted by the consent of the employees and employer, which is incorrect and unlawful in regard of EPF Act.one can withdrawal the Pf accumulation after retirement or unemployed at least two month after quitting the Job.for advance from pf withdrawal allowed before 5 years of contributing the pf accumulation only for medical treatment self spouse, parents children.

i don’t think this is a valid reason for resignation and one should not encourage this. he should have discussed his financial difficulties with the responsible person of the company.

Dear Sir,
This type of problems commonly coming from the middle class families and small employees. Because they need money every time to run their family. If the govt. changes the rules of PF withdrawals like need to work for 5 years to avail for the loan from five years below that five years he/she may have some plans to do the things with budget which ever is higher than his strength then what they will do.
I am not that much experienced to tell this. Just think on it.

Good Welfare Policies and awareness is required to be imparted to employees on PF withdrawal issues.Benevolent funds or other resources if available can be opted to help employees.This will not only boosts the morale of employees but the pride in work places and resultant growth in productivity is encouraged.

First of all, no person, other than PF authority, is authorized to reject your PF withdrawal.
As far as i know, if the HR person in your previous organization is not ready to release your PF amount, you have an option to fill up your form 10C and form 19 and get it signed from any Gazetted Officer and submit in the PF office. This may help out.
