Can an employee, who had completed 58 years of age but still employed, claim monthly pension under EPS?
The employee is still contributing to EPF, and whole of the employers contribution too is going into EPF but nothing into EPS
Below are the full details:
Employee Date of Birth: 11.8.1957
Date of Joining: 1.11.1994
Salary at November 1995: Rs. 2,100/-
Average Salary for 60 months prior to stopping of contribution to EPS- 6,801/-
Date of stopping of contribution to EPS: 1.8.2016

Dear Mr Harish,
Pl advice Employee concerned to apply for EPS Scheme Certificate in Form 10C together with necessary Documents.After receipt of Scheme, he can apply for EPS Pension from the date of attaining 58 Years.He can continue to be Member of EPF till he is in Employment.Once he applies for Pension, he will be issued with Pension Payment Order quantifying Pension Amount with all details

But the concerned employee had already completed 58 years and is still in employment.
My query is whether he can claim monthly pension now, while in service, since he had completed 58 years and no contributions are made to EPS anymore

Dear Mr. Harish, Yes, he can claim pension even if he continue contributing EPF. He is an excluded Employee and exempted for contributing to EPS. Regards, Anbu Loganathan HR
