Dear...

Gist of the all communication saying that Judiciary/Legal process is very lengthy process in India and if you enter in Court Campus than neither you will get employement with same Employer nor you will get employment in other Industreis (every employer will refer your past). Simply you will spoil your self. If you enter in litigation your company will depute some his legal Dept's employee who will attend Court as his duty years together with full salary and benefits but you will attend court for years together without salary but you have to spent huge money on your advocate/appeals/writ petiton.

From the course of Legal action defenetly you will get frustration, poverty and by this, day by day you will come into loop of depression.

Since you are young chap and vast career before you. Hence...

1. Join immediately your present employment and leave one month pay (if yr company is not ready to pay) as fine/punishment. Don't show your smartness after joining and do not try to prove yourself as Hero by showing or gossping that inspite of your miscondut you forced and compel your company to take you back with honour.

2. Show verbal or written apology (if yr company insisted for written statement) to your Supremo.

3. work honestly and hard for another 2-3 years. Learn maximum and then leave your organisation if you get better prospectous( at least that time your company will give you character certificate with goo words)

4. Keep away yourself from such colleagues who instigated you for such misconduct.

5. Life does not have short-cuts, so ensure that you should have proper vision to achive targets/ goals with proper and moral way. This success is ever-lasting.

Last but not least.....I am not saying that one should not fight for his own rights, it is constitutional right. But in your case it is advisable to join immediately your exisiting employment without keeping false ego.

Thanks for realising that taking recourse to legal action may land you in bigger trouble.Legal recourse will take longer time for resolving the dispute; but the company will not pardon you for bringing disrepute to them and may not agree to take u back.It is advisable to join the company now and at the same time search for a new job.

if still they offer you a job without back wages accept it and any provocation may lead to a criminal case against you for fraud and cheating.better settle with employer terms

you have done a mistake. you plainly accepting your mistake, it is good and you realized your self. my advice is do not choose the legal way! it may create problem to your future, it may reduce your confidence levels. if really company will invite you for rejoin, first discuss with HR, if you will get the faith on HR words then rejoin, otherwise search for the another job. do not demand for the salary for those 30 days. all the best for your future.
