i am working with xxx company H.O at mumbai as a sales officer handling vidhrbha region.
i have got show cause latter in October stating that you and your colleague have misconduct with the lady with saying some abuse word at the hotel which was allotted by company,
i have given the answer to hr that we were not involve in this matter and given all the details what and where were we at that time,
but on nov 30 2017 we had been called and given termination latter, at that time we did not accept the latter nor signed that but the HR has made such surrounding we had to accept it
HR says you guys has done we seen the cctv footage but they are not showing the footage to us.
i am sure we did not do this things but we have know idea how to fight with this situation
should i complaint the fir against hr and the hotel manager who complaint against us, what should we do

Dear Mr. Rakesh, You can approach Labour Office and file an written complaint against your organisation only if you are sure about the incident is been forced on you and you are a victim.

If you are 100% sure that no act of misbehaviour was done by you legally challenge by first approaching labour officer.
CCTV footage is without any voice recording so by seeing CCTV recording can it be decided that you have used bad words.
What was the reply given by you to show cause notice?
Can you put the Show cause notice in the forum(hide personal details etc) and your reply.
Then legal experts or HR experts can guide you better.

Dear Kale,
Without holding enquiry and giving you fair opportunity to defend your case, your termination is patently illegal. Engage good labour lawyer and file case against the company. You stand excellent chance of reinstatement assuming that the charges against you are false as claimed by you.

in respect to your show cause notice which you have given me on 16th November 2017 at mumbai ho. , the allegations you have charged me is totally wrong and fact less.
we (me and mr xxx) had dinner outside of hotel and we had entered at hotel by 10.30 pm at that time there were no lady standing at lobby or hotel anywhere, so there is no chance of abusing anyone.
it is my humble request to you sir please check all the facts properly, especially on video footage
i am very much sure you may have seen some one else in footage
i have given my four hardship year to company i have very deep respect for my company and i would not spoil the brand name of company at any cost.

we (me and mr xxx) had dinner outside of hotel and we had entered at hotel by 10.30 pm at that time there were no lady standing at lobby or hotel anywhere, so there is no chance of abusing anyone.

The SC notice makes an allegation of you being drunk.
Have you specifically denied being drunk or even Consumed liquor?
Ask the hotel to give you copy of CCTV footage?
Hotel front office staff have identified you saying you had altercation and your CEO had to speak to them.
What did you tell your CEO?
Anyway you consult a good lawyer and take necessary action.

Dear Kale,
Why are you wasting your time in seeking advice here. Illegal and unjust action is taken against you by your wrongful termination. So seek remedy in the labour court if you are 'workman' as defined under the Industrial Disputes Act. Consult Labour lawyer and proceed immediately.
