Benefit period requirements like 9 months from the date of joining or 70 days of work during the two contribution period preceding the date of delivery will not apply for medical benefits. An employee (and also his family) is entitled to medical benefits from the day one of his joining the scheme. The contributory conditions of 70 days contribution (78 days for sickness benefits other than maternity benefits) will not apply to medical benefits.

Mr Madhu is right.She will get benefit u/s5B of Maternity Benefit Act if she had worked in the present establishment for 80days in 12 months period
