Hi Madhu,
Please help me on one condition. I have deposited a cheque against an offer letter of 3.5 lakhs. It has a non joining claw, if I will not join then I am liable to pay complete amount as recruitment cost.
I have not joined organisation, what can be done in that case? can they force me to pay? I dont have such huge amount

I don't understand why should we deposit a cheque before joining an organisaion? If there is a charge against a future event,ie, not joining the company after accepting the offer, then why should you accept an offer from such a stupid company? It is true that recruitment involves time and cost but it is not valid to collect any amount against it. It may be after accepting the offer that we come to know the real things about the company and,obviously, we will decline from joining. For that a company cannot move legally. Moreover, right to work is always a right of an employee. Therefore,you may issue stop payment order to the bank. Since it is not a dishonour for reason coming under insufficient funds, they will not take any further step.Moreover, the cheque drawn without a consideration is not a valid negotiable instrument
