Dear Seniors
(Requesting you to share your views on below query or direct me to any discussion thread which answer these query. i couldnt find this query discussd in deatails on this forum)
Today is 26th July 2013, precisely 6 days away from last day of filling returns. My organisation is undergoing some financial crisis and is delaying issuing Form16.
I understand that Form16 shoud be issued before 31st May of that financial year.
I visited www,tdscpc.gov.in to check form 26AS and could see that my organisation has only paid 40% of total deducted tax to government.
I understand that paying tax in employers responsibility and they would be penalised for delay.
please let me know if i can go ahead and file returns without Form16 t( i know my tax liabilities) , Will there be any issues in future in case employer doesnt pay tax.

Things got worst , i am informed that Form16 will be given in 3rd week of August. Havent see such thing in my 8 years of service, any guidence would be appreciated... Thanks

If the employer does not remit the tax deducted from your salary and you file your return, there is a high likelihood that the income tax department will send you a notice asking you the remit the tax (which has not been remitted by your employer) on your salary.
