Dear all,
Need guidance. Please go through the following case:
we are the principal employer having 5 units in kolkata. we have engaged a contractor ABC Ent. for house keeping in our unit and against that particular work order the contarctor has deployed 9 labours. The same contractor is engaged in another unit of our co. for the same job and also engaged 9 labours there against a different work order. So all total the contractor has deployed 18 labours with our co. distributed evenly in 2 different units and against 2 different work orders.
Apart for the above the contractor is also engaging labours to various other companies and all total suppose the ABC enterprise has 60 labours working in various co.s including ours.
What will be the liability of the contractor regarding contractor's license point of view. AS enprincipal employer what checks we should ensure regarding contractor's license.

Dear Saptarshi,
It is better that the concerned contractor has a valid contract labour licence. First of all,as a principal employer u must have a licence as per the rules to engage contractor. You as a principal employer must issue Form V to the contractor to enable him to apply for the licence.As contract labour licence is isued by the Contract Labour Inspector it is Zone wise. The contractor needs to get Form V from both of ur units and apply for the licence . As per the check you should make it mandatory that before issuance of work order the contractor should produce valid contract labour licence to the principal employer.

Dear Sir,
You have to have a proper and valid legally drafted agreement with the contractor setting out the obligations clearly. It is mandatory for the contractor to follow all the labour laws and also make provision for gratutity and retrenchment compensation as well as follow ESI and PF acts in letter and spirit. You should conduct periodical audit of these c ompliances to indemnify yourself from lapses.
