Dear friends, One of our employee has filed suit for recovery salary and GRATUITY in spite of giving one month notice, he has filed for retrenchment compensation.in labour court Lucknow, he was giving one month notice period in 2018 May and relieved in June 2018. He did not do proper handover charges and did not come to Hyderabad for final settlement. We do not have an office in Lucknow. Can he file suit at Lucknow we do not have a registered office at Lucknow kindly clarify

Dear Praveen,
In any industrial disputes between the employer and the employees including claims for monetary compensation, only the place where the Employees work or worked last is the deciding factor for the determination of the jurisdiction of the authority for redressal.
Your post is a bit confusing for it speaks about retrenchment also. If the retrenchment compensation is not paid at the time of retrenchment itself, the retrenchment itself will become illegal.

To answer your question we need following answer from you;
1. What type of establishment i.e. Factory, Mines, Shops & commercial establishment
2. What is the designation of the employee
3. Where he was working at Hyderabad or Lucknow
4. What was his cause of termination and terms of notice for such termination
The jurisdiction of the case can be ascertained from above.
