Our office is in Pune & our Head office is in Delhi. The employees ESI returns are filed in Delhi only. I need the information, the employees employed in Pune & Mumbai & coming under ESI Act, how they will get the ESI benefits in Pune & Mumbai?

We have to discuss in depth of this issue:

i. Getting medical Care: First u have to get the information of the employees who are working at Pune & Mumbai, for which dispensary they have opted for medical care........ Since based on the Live List generated by the Branch Offices to the various dispensaries, the dispensaries will provide the medical care to such Insured persons....

ii. Getting Cash benefits: If u have branch offices/sales offices at Pune & Mumbai, immediately u apply for getting a separate sub-code no. to ur pune and mumbai offices..... Since the Branch Office can render the services to any factory such as disbursing of cash benefit to the Insured Persons, if the concerned offices are registered in their jurisdiction only...

After getting the sub-code no. please file the returns to the respective ESI branch offices, wherein ur employees will get the cash benefit also..........

Further to the information furnished by Mr. Shyam Prasad, I add the following:
In case a Branch Office is functioning in another station either in the same State or another State, the following steps need to be taken.
1. Apply for a sub-code number for that branch. This can be done either by the Head Office to the Regional Director of that Region or by the Branch Office to the Regional Director of the State in which such branch is situated. If the Branch Office is applying, please enclose a copy of the Head Office's ESI Coverage intimation letter.The Application should contain the name and postal address, telephone & fax numbers of the branch office, Email ID, Name, Designation and address of the in-charge of the branch, nature of work carried on in the branch, date from which functioning, total number of persons employed, number of coverable employees, Place at which the records are maintained and Name address and code number of the HO, and date of its coverage.
2. On receipt of sub-code number and allotment of ESI Branch Office, all the employees in that branch are to be registered with that ESI Branch Office, by submitting the Declaration forms in Form-1 along with a return in duplicate in form-3. If the employees were already registered in the Head Office area, or at any other place, there is no need to register them again. Their registration is to be transfered to the ESI Branch Office now allotted. For this purpose, transfer application for each such employee in ESIC-53 is to be submitted to the ESI Branch Office.
3. Compliance by the branch is to be made separately in all respects. i.e. Registration of employees, payment of contributions, submission of returns, maintenance of Form 6 Register etc. This will facilitate the employees in the branch to avail medical benefit from the dispensary of their choice in that area and cash benefits from the respective ESI Branch Office.
