Dear Sir/Ma’am, Kindly Provide the information if an IP dies in his Benefit Period due to Employment Injury on duty during working hours. Will his wife be Eligible for Dependent Benefit?

yes, IP' s dependent will be entitled for Dependent Pension (Nominee, Spouse and first 02 children up to age of 25 years) also Nominee will get a lumpsum amount Rs.15000/- as a funeral expenses.

Thanks for your reply but the problem here is employer deduct ESI Contribution above wage ceiling 21000 from beginning of contribution Period (from October) and Submit to ESI and ESI accept his contribution (no objection from ESI till death of IP). Later on employee die on duty due to employment injury and when Family go to ESI, they refuse to give Dependent benefit and giving the reason IP was drawing salary more than ESI wage Ceiling. ESI contribution is deduct from employee salary and submit to ESI till death. now what can family do in this case.
