Any trainee enrolled under Flexi MoU scheme in a manufacturing Plant is covered under EC Act 1923 for Disability compensation.
All persons engaged or employed in an organisation are eligible to get compensation under Employees Compensation Act. In respect of an employee including trainee who is covered under ESI Act, the compensation admissible under the Employees Compensation Act will be taken care of by the ESI Corporation. For coverage under Employees Compensation Act the system of reward has no relevance. In the absence of any evidence to show what is the actual remuneration for service, the appropriate authority will take Rs 15000, the maximum salary as per the Act, as the base for deciding the amount of compensation.
