if an employee joining date is 02.09.22,does she/he is eligible for EL,for the year 2023 and when will company add it in his/her leave account.

It depends on the leave rules/Standing Orders of the company. you may consult them. Normally EL accrues after one year of service.

If the employee has worked for 80 days (including the paid weekly off, holidays with pay etc) in the year 2022, at the rate of 20 days in a month, he will be eligible to leave in 2023. His leave would, invariably, be limited to one day for every 20 days physically present.

The leaves are calculated on calendar year basis at per Factories Act. Hence the employee can be given leave on pro rata for the year 2022.

Yes, He / She is eligible for EL. But It's depends on the leave rules/Standing Orders of the company. It will calculated on employee's physical working days. If employee joined on 02nd Sep 2022, then her / him physical working days is approximate 100 days so employee is eligible for 5 Days EL.

Dear Member,
For eligibility of EL we are to see that which of the Act is applicable to the employee /worker. In general we are to examine which of the Act out of Factories Act, 1948, State applicable S&E Act, Certified Standing Orders, EL policy of the company which should be better than applicable statutory law etc. is applicable in this case & then we are to go through that applicable Act to finalize the eligibility of EL after going through the provisions of that Act.
