Our construction company has less than 10 permanent / temporary employees at any given point of time. We had completed a RERA-registered residential colony in 2018 by using casual labour and manpower supplied by labour contractors. However, we have received an EPF notice recently seeking to enquire into our business. Will the casual labour / contract labour be added to reach threshold of 20 employees for applicability of EPF Act, 1952?

If your company has less than 20 employees ( permanent/casual) then you don't need to worry, but if including contract labour the count goes beyond 20 than you need to enroll to pf and give pf to your all employees.

If your contractor is complying with PF Scheme for his employees, then you need not bother , otherwise you are required to comply and there is no escape from this legal obligation.
