Employee joined firm and was given ESI. He filled PF Form 11 stating he did not have any past PF. As his salary of 18000 was above PF bracket, firm just gave him ESIC benefits. Now after 7 months of work, employee is demanding PF and saying that he was a past PF member and showing old PF records from his previous firm.
What should we do now?

Welfare contributions are to be offered to all employees on uniform basis, it does not matters that the basic of any employee is more than 15000 so he "excluded employee" unless the employee does not tenders in writing that he/ she is not a member of PF and does not want to join

employer has option to take disciplinary action against the employee for giving FALSE information, in form 11
