I have been with an IT MNC for the last 4 years and now I have joined the govt organization. There is an overlap of 2 days between the last IT MNC and current govt employer. Last date in IT MNC was 01-Oct-2020 and DOJ in govt organization was 29-Sep-2020. I have paid a penalty amount to my previous employer for a shortfall of notice period for the period of 01-Oct-2020 to 20-Nov-2020. Now in the release letter, my last date of service is mentioned as 01-Oct-2020. As the previous employer was a pvt firm, current govt employer told me that it is not necessary for me to submit a release letter. My question is, will it cause any problem in the future?

I don't think you'll have any problem. Especially you had a buy-out till you were relieved/20.11.20 and didn't earn salary till 1.10.20 from the MNC the overlapping should not cause any problem. Having already received your release letter and your present employer doesn't insist the very same letter there is no worry, I guess. If they would insist the letter as part of their procedure in due course you may submit it when demanded. Any overlapping, dual employment would cause difficulties when anyone receive salary for the same days from more than one employer. If you are yet to submit the joining report to the present employer, you may attach a copy of relieving letter for their records.

Can any one please help me to clear my confusion? I had a buyout from 01-Oct-2020 to 20-Nov-2020 (51 days) however they have payed me salary for full September. On the other hand I have joined Govt org on 29-Sep-2020. So whether this 2 day of overlap will cause any problem?

What is the issue, when your controlling officer has clarified that no release letter is required in joining the new post? Obviously, you have already joined. Let the past be past.

In any case you have to refund the emoluments received for the days overlapped in order to avoid complications of like 'unjust enrichment'. You can receive salary from two employers for the very same days.
