Yes it is applicable even to the software industry so long as the other criteria of having more than 10 employees is fulfilled. Once registered under ESI it will be applicable even if the strength goes down the required mark. If you have insurance which is much better than the ESI and applicable to all the employees you may have to prove the same to the authorities to take exemption. You need to first register your company with the ESI before going for any exemption which is an exception rather than a rule.

ESI is applicable to all factories, shops and establishment engaging 10 or more employees (all types of employment) on any given day in preceding 12 months, the ESI Act will be applicable. However it is also important to find whether the geographical area where your establishment is situated has been notified by ESIC as implemented area or not. Implemented are is the area where ESIC has made available dispensary/Hospital and other infrastructure to extend ESI benefits to prospective members.
Please find here attached a list of such areas in state of Tamilnadu.

Hi, Yes, ESI applicable for IT also whose Gross salary is less than 21,001.

Thank you for your reply for my ESI quary as well as your contact mail.
The company is running around 5 years but still not registered under ESI. They are saying it is exemption for the company.
I couldnot find the reason

Dear Member, Please find out whether your Industry is located in "Non Implemented Area"
Who has given exemption. on what grounds, do you have any Documents in support of this?
Do you have Employees drawing Gross Salary of Rs21,000/-PM & Below
Please also find out ESI Applicability to neighbour Industries, visit nearest ESI Office to get information
