Yes it is applicable even to the software industry so long as the other criteria of having more than 10 employees is fulfilled. Once registered under ESI it will be applicable even if the strength goes down the required mark. If you have insurance which is much better than the ESI and applicable to all the employees you may have to prove the same to the authorities to take exemption. You need to first register your company with the ESI before going for any exemption which is an exception rather than a rule.
