Hello, I want opinion on Sandwich leaves.
1st Scenario: If employee takes leaves on 1st September i.e Saturday and 4th September i.e Tuesday. 3rd September, monday is janmastami holiday, will it be considered as sandwich leave?
2nd Scenario: If employee takes leave on Monday between Sunday and dussehra holiday i.e Wednesday, sandwich leave rule will apply?

What is the type of leave applied? In case it is casual leave, most organisations do not count the holidays prefixed or suffixed but in case of other types of leave, the intervening holidays are counted

In your 1st case as per my knowledge its applicable sandwich rule. employee is absent continuously from 1st September to 4th, if he present on 4th then sandwich rule not applicable.
2nd case if employee takes leave from Monday i.e 15th to 17th then only 2 days will deduct from his leave balance i.e 15th & 16th only considering he will present on 13th & 18th

It depends on the policy of the company. If it is CL some company do count as leave the intervening holidays and in some it don't.
However as per Factory Act in case of EL holidays intervening leave is not counted as a part of leave.

Hi, Friends, In my view, if the said employee availed any leave between the two offs, it will be treated as leave of all three days on the basis of PROF-EX - AFFIX rule.
