As far as my knowledge goes, the paternity leave,. concept in not a legally made applicable in India.

Hi Sandesh, Paternity leave depends on employer/ Company policy. Legally it is not applicable.

The paternity leave is not in position for establishment under private besides their own policy. Some of the Central Government establishments have the facility. As of now no such law or Act has framed for observing.
