BOCW, EC and ESI acts are social welfare legislation for the labour class while BOCW Act pertains to unorganised sector, EC/ESI addresses the organised labour. BOCW ACT 1996 applies exclusively on the construction industry and BOCW Cess is attracted for construction worth more than Rs. 10Lakh.
The EC Act 1923 provides for payment of compensation for employment injuries while ESI Act 1948 is a multiple benefit act including compensation for employment injuries. Where ESI Act is applicable, there EC Act will have no applicability.
