Dear All, Employer is asking to submit the original documents. Is it legal to take employee original marksheets and certificate as a job security? Kindly comment on this.

No. It is unethical to with hold original certificates of candidates. The company can ask for the documents to verify them but not retain them as a security.

If there is written agreement by employee and employer to retain certificate by employer as security then it can be labelled as legal.

Hi Sufian,
Generally companies ask original certificates from employees who handle cash. If this is not feasible discuss with your employer and convince.
It is not a legal point to collect originals from employees.
Because some employees also tend to deceive the companies, these kind of rules came into existence.

""Generally companies ask original certificates from employees who handle cash""
Instead of our typical shortcuts, company needs to take Fidelity bonds for such employees who are handling cash.
Original educational certificates are personal property of employee.Incorrect to retain them as security.
