Hi, I have ben employed with company since year 2012.Till march 2016 I was covered under ESI, later changed to med claim as my gross was more than 15K,
Again as per revised ESI rule ,from Jan -2017 I was returned back to ESI facility since my salary not crossing 21k.
Now I am expecting baby delivery by august 2017 first week .
Since my ESI contribution is not there from April 2016- to Dec -2016. Officer told maternity benefit not applicable to me.
How to avail six month leave benefit from my employer in this case. Pls suggest

Hi, It is very peculiar case.
However if I am correct though you are not eligible for availing maternity benefits under ESI Act, you are entitled to get maternity benefits under MB act.
You are eligible for Medical bonus and maternity leave benefits

Hi, As Mr. Ramesan said correctly you need to put forward an application to your management for Maternity Benefits.

Sir, under ESI Act any cash benefit speaks you have to complete 9 months of your first insurable employment, in your case you were already registered under ESI Act, but due to salary enhancement you have gone out of coverage and reentered into insurable employment wef: 1.1.2017.
It seems some clarification has to get in such cases from the ESIC HQs.... you are advised to approach your concerned Branch Office/Regional Office for further guidelines in this matter..

In ESI Scheme the Contribution period is April to September and October to March. The corresponding Benefit period is Jan to June and July to December.
The Leave encashment for the Maternity Benefit can be claimed as the Insured Person is now in Benefit period.

Yes, You are entitled for Maternity Benefit under ESI Act as you had been Insured and paid contribution from 2012.
