Hi, I has submitted my resignation on 1 Nov and on 2 Nov I was serving my last day at the company. I had written in my resignation letter as relieve me as soon as possible. Out company has a policy of 3 months notice period. On the last day of my employment my employer rights as all ur PL has been adjusted against your notice period and balance days has been waived of for notice period.
My question is that company should either give me gardening leave or waive of my notice period and pay my leave encashment? Right?
Kindly help me to resolve this issue

Dear Mittal Ji,
There are the following terms as per your appointment letter.Please clarify---
"Confirmation and notice period - Provided your services come up to the standards required by the company, your appointment will be confirmed in writing. After confirmation, your appointment will be terminable at any time by three months notice by either party or on payment of three months salary in lieu of notice.
The company reserves the right to:
a) Sanction privilege leave during the notice period
b) Adjust privilege leave balance towards the serving of the notice period.
The decision of the company will be final in this regard."
