In my last thread I had raised the question of rule of allotment of Insurance No. with in ten days. If notification in-forced from October 1, 2016 it would breach of law and in current position notification yet not in-forced as such we can't get the Insurance number. Should we get the Insurance number of those persons, who are expected to become member under the scheme?

Sir, the requirement of compliance of any rule/regulation/law arises only after the said law or amendment is made effective by the competent authority/appropriate Govt. through Gazette notification.

In our earlier gazette notifications in enhancement of wages limit under ESIC legislation is prospective not retrospective and hence any gazette not published before 30.09.2016, can be treated as not implemented and you can continue to recover ESIC Contribution on Rs.15K only for next six months.

Notification No. F.No. S-38025/04/2010-SS-1 dated 20th April, 2010, the Ministry of Labour & Employment has enhanced ceiling to Rs. 15,000/- per month w.e.f. 1st May, 2010 which is reproduced below.
Please check the last notification. It has come in force from May 1, 2016 i.e. in between of the contribution period. As such this notification may be effective from 1st December 2016, because notification may not be issued before 5th November. Hence it would have to implement from retrospective date.
Check the last issued for objection from the public was raised on 26.02.2010 and re-notified in the gazette in April 2010, which effected from prospective date i.e. 1st May 2010. Hence this notification may not be possible from 1st December 2016.
