Hi all, Kindly, let me know if ESI is compulsory for all employees or not/ even a higher wages employee comes under this or not/ if yes then how and why?

ESI is applicable for the employees who are drawing gross salary 15000 or less only.

Dear member, coverage under ESI Act, 1948 and rules/regulations framed thereunder is not optional. If the factory / unit is coverable, the compliance in respect of coverable employees is compulsory. Employees getting wages exceeding to coverable limit (except amount of over time) cannot be covered from the start of new contribution period.

As per ESIC Act, the establishment or factory employing 10 or above persons is eligible to get the ESIC code. There is a slab to get the benefit of ESIC , the slab is, who is getting below Rs.15000/- wages is eligible and who getting above Rs.15000/- is not eligible.

PFA copies of Notification by ESIC extending the coverage in all the Districts of Maharastra, Bihar, Rajasthan and Karnataka. In few months the Scheme may be extended gradually in all the States so that all employees will be covered and get the benefits from ESIC (including the recently amended Maternity Benefit).
