Sir I am working in Mistral restaurant(Lettuce entertains you ltd.) from10 Apr 2015.It's a PVR cinemas restaurant. before some days company starts saying that our restro going for renovation so they transfer all the employees to their other outlets in PVR so everybody has to resign and rejoin in PVR cinema from lettuce and they will provide increase salary.Suddenly on 31 may they asking for resign,all the employees given their resigns and hr manager offered them new lob location with good salary but actually we four guys are from different department called bakery.Company sad we don't need bakery guys as they are starts purchasing the bakery goods from outside so give your resign and go home.
We sad how can company do this with us, we refused to give resign and come back home.As per employment rules if company closed suddenly and leave their employees in between without any notice they have to give some amount as basic salary for three months to their employees but they refuse it.
Pls. guide us sir how can file complaint in labour court so that we can get our compensation.

Company has totally fooled and tricked you into giving resignation. A company has right to transfer its employees to other location due to exigencies of work. However, for that the company has to issue order of transfer and at no situation an employee is required to give resignation. If you resign from company A and joins company B, then it does not amount to transfer and your continuity of service is lost, even if company B provides 10 times more salary.
There is a procedure of termination/ closure/ retrenchment depending on the nature of establishment and strength of employees. You can surely challenge such illegal termination. Please note that it is better not to accept any notice pay from the employer if you wish to challenge the termination in the court of law.
Please consult a lawyer with all your documents and act accordingly.
