Dear Seniors
Sorry to inform you that I have been working as a secretary to Director in one of the steel m anufacturing company of chhattisgarh. The compnay's financial health is not good since last more than one year and we are not getting our salaries till 20-22th of every month there is no annual increments since last one year.
Recently our management has been behaving erratically with eachand oevery employee and created a atmosphere of terror our director is very short tempereted and every time take an empoyee at centre left and right without any reason just to terrorise the emplloyees morever there is deduction of 24% from our salaries towards contribution of pf which is un justified...

recently my director for no reasons shouted at me an d literally abused me infront of a HR staff who as also inside the chamber i am horrified with this erratic behaviour and really scarced.. please advise what to do.. coz there is atmosphere of negativity and gloom in each and every department every day people of leaving the organization and this director is employeing new candidates.... It is the practise adopted by the management every now and then they are targeting any particular employee tortue him by shouting scolding infront of juniors or literally use abusive language so that the employee can leave the company and they can swallow his hard earned money.......

there is chaos in our company going on in my appointment letter notice period mentioned is three months please advise what to do moreover the employees who left earlier was not getting their full and find settlement money since last two years.. my service with this co is about 4.6years and my retention money is blocked with the compnay company is retaining lta and medical component (approx 2500 pm) from the employees and give after completion of two years or three years whenever they feel deem to pay.. ther eis no hard and fast rule moreover forthcoming bonus is pending.

I am in dilema as diwali is approaching after fortnight... whether to resign and wait till the diwali so that i can get my bonus and some part of lta and medical or any other way out t o take this matter with the legal authorities so that matter can be resolved.

Please advise what to do...

Wait for Diwali bonus and then quit rather than jumping in the legal fray to cause hardening of higher management’s attitude towards you, besides wasting money and time.

I agree with Nathrao that ONLY a collective approach will work here.....any individual effort will be counter-productive.
However, PS Dhingra is right in asking you wait until Diwali......having waited for so long another couple of weeks is worth it. What IF the management decides to pay at least some Bonus?
And also, suggest DON'T begin discussing the legal aspect with any other employees right now UNLESS you are very sure he/she won't carry the news to the management......this attitude is fairly common among manufacturing sector employees in your part of the country. If this news that you are planning legal action leaks out, whatever chances of a Bonus will go for a toss.

Many of the things you have written are normal is an industry under stress. Other domaines including some of my clients have not given increments for 2 years. Many companies in india facing cash flow issues are delaying salaries. But at least you are getting salaries while many other posts talks of not getting salary for months together.

So the solution is simple, find another job and leave. Why would you continue to work for a company which can't pay on time and not paying salary that you think you deserve.

There may be a difference of perception. He may have a justified rant against the employees for messing up things. Stress of financial problem tends to make people short tempered and things that they would have accepted earlier often become unacceptable now.

Now, I think you are confusing salary and CTC. Please see earlier posts on deduction of employers share of PF on this forum and you will understand that this is accepted practice. But you have worked there for 4 years. You are now suddenly having a problem ? Were they only deducting 12% in earlier years ? If so, you would have a case before the PF department.

Ok, please explain how creating a situation resulting in people leaving is "swallowing their heard earned money". The company is not liable to employ you for life. Once you leave, they don't pay you. Or did you mean something else ?

Again, you seem to be under a misconception. LTA and medical reimbursement are not payable each month. They are paid at certain times as per rules. So this is not retention. They are not liable to pay LTA unless you actually travel and they don't need to pay medical until someone actually has bills for genuine purchase of medicines.

When to leave is a decision you alone can make based on real circumstances you alone know.

It's better to leave when you get a job. Once you get the job, forget about pendings and walk off to a better environment. It makes more sense ofcourse to wait for payment of bonus and salary and then leave. But it may not be possible if The new company does not want to wait.

Scores in the manner of your leaving, it is likely that you will not get any relieving letter. Make sure that your new employer is willing to except you without a relieving letter from the existing company. I do not know whether it is possible for you to actually serve a three-month notice… But you will need to take a call on that based on these circumstances.
