Dear All,



I am working with a Construction company and we have sixteen Sub-contractors.
But they don’t maintain all register, EPF deduction and all legal formalities.

We deduct EPF Amount from their bill . We have contract Labour License on behalf of them.

Can we maintain all register on Behalf of them?

You have to maintain subcontractor wise attendance register Form XIII, Wages Register, Muster Roll, OT Register, Register of Advances, Fines and Damages or Loss Registers (Form XX, XXI & XXII). Because you have only obtained the Labour Licence under Contractor Labour Act. So you have to maintain the same.
You must maintain Form V Form X and PF Account Nos for all the workmen and you have to submit their PF as required.
Maintain their Wages Register, Attendance Register and PF Challan remittance details in equal and make sure that there should not be any variation or difference.

Dear
The CLRA provides that Statutory coverage is to be provided at one point . Primarily by the Contractor.If the Contractor is not an organized person or a Professional then the burden shifts to the PE.

Hi,
Your Company seems to Principal Contractor of the company and you have engaged Sub- Contractor. Since being an Principal contractor has to ensure that all the sub-contractor meet the legal requirement for their contract worker. in your case the sub contractor doesn't. Hence request you to kindly maintain consolidated register and record with respect to the sub contractor and other WC/ESI/PF/Minimum wages/Payment of wages/Building and other construction workers/Cess/Contract Labour/ISMW/ etc

The term " Contractor " defined in the CLA includes a sub contractor. Therefore all what is applicable to a contractor is equally applicable to a sub contractor.In case the sub contractor does not have a licence, then under the CLA,all contract labour employed by him will deem to have been employed by the principal contractor.This is the fall out of not the asking the sub contractor to obtain licence. Your licence should include the number of contract labour employed by the sub contrctor.

First of all the Principal employer has to register/add the contractor's name in Certificate of Registration (In Form II) for which a register is mainained at Labour Commissioner's office.
If your name is not available then you cannot obtain the Licence under CLA.
Your PE should add your name in Contractor's list then only you can apply for licence under contract Labour Act.

Dear Alok Singh,
Mr. Bhaskar has rightly mentioned the list of registers to be maintained from ur end being principal employer . Further , since your company is doing contruction work , u have to apply for Registration under BOCW Act also. And after getting Registration , further maintain all the registers / records are required to mainatained under this Act also.

Dear Mr. Sharma,

We have BOCW License however it is necessary to maintain all the register under BOCW Act & contract labour Act.
If we prepare wages register & workmen employed by contractor under CLA.
