my company is not paying salary..for the last two months..and its not providing any ESI,or Pf facility to employees its a news channle

Hi,
As per Payment of wages Act, company to be pay employee's salary 7th of following month.if they will make any kind of delay , company is liable to pay interest on that so this is the legal law.
if salary is pending from last 2 months better to concern Labour inspector under Payment of Wages Act. ( if Salary is 18000/-pm)

All laws are being violated by this news channel.
PF,ESIC and non payment of salary.
Probably in a group you can approach higher management.
Is salary not being paid to all employees or only a few?
Being in the same company employees can make out is financial problem genuine or management is being funny.
PF commissioner, ESIC can be approached with complaint about not being subscribers to these schemes which are mandatory.
Take joint action in this matter.

thanks for your reply..the chairman threatend the employees that he will terminate them if any body goes to labour inspector do you suggest any route for this

Omelette can be made without breaking an egg.
Accept the risk in going to official agencies or accept late payments and less savings/protection like PF/ESIC.
It is difficult but then this a fact of life.

Hello Mukkanti,
W.r.t. your line "the chairman threatend the employees that he will terminate them if any body goes to labour inspector", that is bound to happen IF one or a few employees go. The ONLY way to handle this is for ALL the effected employees to go to the labor Inspector.
If not, the ones who went will surely be targeted by the management.
Like Nathrao mentioned "Omelette CANNOT be made without breaking an egg" [he meant this than 'can' I presume].
But let it be a collective action rather than individual or by a few.
And, also suggest look for other jobs in the meantime ASAP.

Dear Friend,

It seems your organisation is exploiting your services and threatening...Where did your channel is functioning?

Firstly, all of you are not getting salary or wages or in kindness or some of your friends along with you are not getting salary?

In the case of some of the people/employee are getting salary they may ignore you and others who are not getting salary..better in that case you certainly have attendance sheet, daily presence is being marked by some one..get a copy of the same or take a mobile click...it is very much essential...

Secondly, Whether all of you have got letter of employment or working on word of mouth?

Thirdly, Are all of you have bank account for crediting in your respective salaries or you are all being paid by cash?

Fourthly, Have you got your terms and conditions or work contract clearly furnished?

In the absence of any of the above, it means you are all being engaged for exploitation...better approach the labour officer and put up your complain in writing for better action...

Can dispute be raised in civil court besides in labour court for a WORKMAN on Non payment of salary as labour court processes are too slow.
