Dear Sir I recently joined a new COMMERCIAL VEHICLES firm I was on my probation period for 6 Months also In my offer letter it is clearly written that if I leave in my probation period it is on my wish to complete notice period or pay for same. I am ready to pay for my notice period but the current company is not ready to accept my resignation secondly I have dropped them 10-15 mails asking for relieving but they are not replying to my mails. Also I want to join new firm in next 3-4 days. Please guide right step to come out of situation.

How many days have you worked in this company??
How much was the notice specified by your employer?
Give a written communication duly signed that as per offer letter you are leaving the job.(Take it by hand and get it acknowledged)
Date of leaving will be ----.
I hereby hand over all company property-laptop etc.
Kindly acknowledge.
I am ready to pay Rs------ in accordance with offer letter.(Basic salary + dearness allowance only and not gross pay)
Then you can leave even if company refuses relief.no one can compel you to work there if you do not wish.

You have sent them 15 mails informing them that you are resigning as from..........!(presume that you are within the notice period) Please send a letter immediately giving reference to all 15 previous correspondence in this regard and state that you regret for their poor response. State clearly that you will not be reporting for work as from........and that you will not hold yourself responsible if you are not relived from your responsibilities by that time. Send this letter by Registered Post copied to the Managing Director. That would do good!
