Dear All,
We are a engineering consultancy,Currently we have two full time and five employees on consultancy base (Even all are drawing more than Rs.25000/-) .Kindly advice me how to get registered with ESIC.
In the case we are not applicable/Eligible to get ESIC, can I get any certificate like registered but not applicable.

The ESIC is applicable to employees drawing compensation below Rs. 15000/- per month. Also, the strength of your consultancy is only 07. As per the Act, Employee State Insurance Cooperation is applicable to companies who have more than 20 employees. You don't fulfill both the criteria.

1. Sir, coverage under ESI Act, 1948 and rules/regulations framed thereunder is not optional.
2. However, ESI Act is applicable in those factories which are situated in implemented areas as notified under section 1(3) and where 10 or more persons are employed. The term "person" is very wide and will mean all persons employed including casual, temporary, and on contract basis.
3. Some of the State Govts. have also extended the provisions of said Act under section 1(5) to some establishments employing 10 or more persons.
