As per the new PF amendment whoever falls below Rs. 15,000/- of salary/wages per month then they will have to contribute compulsorily to EPF. But if the contractor manpower strength is less than 20 nos and the labour wages is also less than Rs. 15,000/- then does the contractor need to get the PF Registration?

If the principal employer is employing more than 20 employees than contractor also need to cover under EPF act if the principal employer is not covering the contractual employees in his PF code.

Even I had a confusion with the latest amendment. Our company has been registered under the PF Act, but one of our contractor does not have his PF Registration as he has never had his labors above 20 ever since he has joined.
The Contractor does not want to register under the PF act.
Is it mandatory for the company to pay the PF of his labor on his behalf or not?
And in case if we need to contribute the PF, will the contractor be liable to pay back the amount of the contribution.
What I have been advised is that it is irrelevant to how many labors were employed. If the Contractor does not contribute the PF then the Company is liable to pay the PF.
