Dear All,
I work in a SSI as an HR executive.We do not have ESIC facility for contract workers.
Recently a worker has joined our company on contract basis and he had ESIC facility at his previous organisation.
He has paid contribution for seven years in the previous company. Now in our company he is not paying contribution since 3 months. My querry is can he avail ESIC leaves and can we let him avail those?If the contribution is not paid, what will happen to the employee's account?

Dear member,
1. You have not indicated in the remarks whether the unit in which you are working is covered under ESI Act ? If so, why you "do not have ESIC facility for contract workers".
2. If your unit is not directly covered under ESI Act, whether the contractor your unit engaged is having separate ESI Code Number on the basis of number of workers engaged by him as a "shop".
3. If your unit is not covered under ESI Act, then what are the number of persons engaged in a month and also how many persons are engaged through contractor on contract basis.

Dear Member,
ESIC provisions do not distinguish between regular and contract workers.His compliance can be made on your company ESI Code.His Insurance no. will remain same.In case his contribution is not deposited he will be deprived of ESIC benefits in future and your company will be a defaulter.
