Hi,
I have left my company after working for 2.5 Months. with proper procedure of resignation and Relieving.
I have received all legal documents like Relieving letter and Experience letter.
Initially they told the settlement will be done in 45 days. But it is almost 4 months, since I have left and settlement is still pending. I have been following up from last 2.5 months. But not proper response and its pending. Even if they respond sometimes, they will simply tell, it will be done this month.
Please advice, what should I do.

Hi Shanth,
How have you done the communication? Oral or written? If you have the written communication with you it is good for you. As in you have the proof that you can use in future if need be.
Write them the firm yet polite email / letter asking to clear your salary as soon as possible else you would be forced to take the action because of the salary not paid inspite of waiting for it since long.
Many a times company pay out to avoid any legal action. If they still are stubborn, you can always have the choice to go legally.

Thanks for the reply.
Yes, I have a long chain mail with the HR - Manager, he replied twice saying will be settled this month.
Initially the used to receive my calls and say the same that it will be settled soon.
Now a days he does not even receive my calls nor respond to my mails.
I am tired of following up with them. I am writing polite mails every week.
the only way I see is to inform them that I will proceed with legal ways if not settled in next 1 month.
what would you suggest, how is the legal process?

Dear Shanth,
The senior members sometimes hesitate to contribute or express their opinion due to the reasons that the queriest do not provide complete inputs.What we expect from them is that they should invarably give the following pariculars:-
(i) the type of organisation, where they work (ii) Nature of activities undertaken by the organisation (iii) Position and their salary of the queriest (iv) Place of work (v) No. of workers/employees serving in the organisation and similar other information relating to the service conditions.
In absence of the above particulars, I can only suggest you to approach to the Authority appointed under of the Payment of Wages Act,1936 of the Stats/Central,as the case may be and raise a claim before him for the delay in payment of wages under Section 15 of the Act.

Dear Shanth
You may escale the same issue to HR-Head of company with previous trail mails.
If the HR Manager only in the company to whom you dealing with, it's better to escalate this to Higher management of company.

Hi,
I have written several polite mails to the HR team but no proper response.
And its been 5 months since the salary settlement is pending. In my last mail I also have mentioned that, I would be forced to proceed in legal ways if not settled this month (May 2014).
But I don't get any response from the higher management team or HR team.
Please suggest how I can proceed legally to send them a Notice and whom should I send the notice to?
